Terms & Conditions

Mutual Terms: 

  1. Scope of Services. Foam Roller shall provide live DJ entertainment services for payment by Client as specified in any provided invoices.  
  2. Termination. This agreement may be terminated by either Foam Roller or Client at any time, subject to the Event Cancellation Policy.
  3. Notices. Notices or communications required or permitted under this agreement shall be given to Foam Roller or Client via email at bookings@foamrollermixes.com. 

Responsibilities of Foam Roller: 

  1. Equipment. Foam Roller shall provide its own entertainment equipment necessary to perform services pursuant to this agreement. Foam Roller is not liable for adverse conditions caused by the selected venue, including, but not limited to, unfriendly weather or inherent connectivity challenges.
  2. Indemnification. Foam Roller agrees to indemnify and hold harmless Client from and against any and all claims, actions, liabilities, and damages, however caused, for loss of or damage to any property or for bodily or personal injuries, including death resulting there from, sustained by any person or persons, to the extent that such damage or injuries result from or arise out of Foam Roller’s performance of this agreement, negligence, or violation of law.  
  3. Limitation of Liability. Notwithstanding indemnification by Client, Foam roller shall not be held liable for any incidental, special, or consequential damages arising out of Foam Roller’s failure to perform under this agreement. 
  4. Event Cancellation Policy. In the event that Foam Roller is unable to provide agreed upon services, Foam Roller shall provide notice as soon as possible. Client will not have any obligation to pay Foam Roller, and Foam Roller shall return any payment already made, for the above events. 

IN NO EVENT SHALL FOAM ROLLER BE LIABLE FOR ANY DAMAGES, NOR SHALL FOAM ROLLER PAY ANY AMOUNT, EXCEEDING THE TOTAL COMPENSATION PAID BY CLIENT TO FOAM ROLLER. THIS TERM SHALL SURVIVE THE TERMINATION OF THIS AGREEMENT. 

Responsibilities of Client:

  1. Reasonable Access. Client will provide Foam Roller with reasonable access to rooms, outlets, sound systems, and other permanent fixtures and furniture as necessary for Foam Roller to provide its services pursuant to this agreement.  
  2. Indemnification. Client agrees to indemnify and hold harmless Foam Roller from and against any and all claims, actions, liabilities, and damages, however caused, for loss of or damage to any property or for bodily or personal injuries, including death resulting there from, sustained by any person or persons, to the extent that such damage or injuries result from or arise out of the Client’s performance of this agreement, negligence, or violation of law.  
  3. Licenses. Client is solely responsible for obtaining and maintaining all necessary permits and licenses for its events, including for performance of any specific music or songs. 
  4. Event Cancellation Policy. In the event that Client no longer requires Foam Roller’s services, Client shall provide notice to Foam Roller as soon as possible. If Client cancels the event, Client acknowledges that the 50% non-refundable deposit will be forfeited.
